Jury convicts man for raping 16-year-old girl

Following a three-day trial, a jury found a former Las Vegas firefighter guilty of raping a girl he lived with.

The jury deliberated for nearly six hours before finding David Garcia, 48, guilty of criminal sexual penetration of a child. Garcia is scheduled to be sentenced April 14.

The rape occurred in 2016 — when the girl was 16 — and was reported to police in 2018. The girl told police she was awoken by Garcia when he began rubbing her back and tickling her stomach, according to an affidavit filed in San Miguel Magistrate Court in 2018. Garcia then penetrated her vagina with his fingers.

When the girl told her mother about the rape, the girl’s mother confronted Garcia. She told police Garcia said, “I didn’t mean to hurt you,” according to the affidavit. Garcia was arrested Oct. 4, 2018. Prior to his arrest, Garcia was an engineer with the Las Vegas Fire Department.
