Charges filed after investigation of sexual assaults on two children

Charges have been filed against a Las Vegas man following an investigation into allegations that he sexually assaulted two children.

Jose Stanley Saiz, 73, is charged with two counts of criminal sexual contact with a minor following investigations that began in July.

Investigators with New Mexico State Police allege Saiz touched the genitals of two children over clothing, according to an arrest affidavit filed in San Miguel Magistrate Court.

Police allege the first incident took place inside a Las Vegas-area home in July. Parents of a 7-year-old girl told police Saiz had asked to use the bathroom in their home, and that soon after, their daughter ran to them to say Saiz had put his hands down her shorts.

During a forensic interview a counselor determined the sexual contact had happened over the girl’s underwear, and the girl told the counselor Saiz had done something similar to another child.

A counselor spoke with the other child, a 10-year-old boy, in August.

The boy told counselors that he was inside Saiz’s Las Vegas-area home when Saiz showed him pornographic images before he rubbed the boy’s leg and “grabbed” his genitals over his clothing, according to the arrest affidavit.

The boy also told counselors Saiz made comments about wanting to have sex with one of the boy’s relatives. The boy said he didn’t tell anyone about the assault because Saiz had shown him firearms — including a rifle and a handgun — and he was afraid for the safety of his family, according to the affidavit.

Saiz was arrested Aug. 21 and booked into the San Miguel County Detention Center following the investigation by State Police. During a hearing that day, Judge Melanie Rivera set bond for Saiz at $10,000 unsecured, and though Saiz was released from jail, he was placed on house arrest at a home in another city.

Conditions of release for Saiz further state he cannot possess any firearms, consume or possess alcohol or illegal drugs and that he cannot have contact with the children or any potential witness in the case.

Saiz is scheduled to appear in San Miguel Magistrate Court Oct. 1 for a preliminary hearing.
